from what i read online (retail forum) about this matter the tabard was selled in IF (alliance) or Ogrimar (horde) for every one for 2 gold to every one till later expansion 4.1
so at WOTLK i suppose is legal. xD it was a bug but every one who got it was able to keep it even after blizzard fix it at 4.1 expansion.

Hi, just fyi this bug was created in patch 4.0.6a not in Wotlk, so in this case I do believe that the hunter in question got it via other means, probably from a vote shop on his previous server.

it was given freely by the tabard vendor in Dalaran for a while

my alliance chars have it but cant use it

not true. any Paladin can use it no matter the race or faction.
